Proposed Resale Legislation in New York


Legislators in the state of New York recently returned for the start of the 2010 session, and ticket resale is again on the agenda. Three bills concerning ticket resale have been proposed to the New York State Assembly.

A08623A prohibits the agents of a venue operator from selling or converying tickets to a secondary ticket reseller owned or controlled by the operator's agent. It also requires disclosure by the operator or promoter as to which seats have obstructed views and calls for a study of ticket resale to be performed by the Consumer Protection Board.

A08283 limits ticket resales to no more than 25% above face value and bans ticket resale until one month after the initial sale. It also requires disclosure of how many tickets will be released to the general public at the time of sale and which seats have obstructed views.

S06444 extends the current resale law until May 15, 2012.

The Better Ticketing Association asks that all New York ticket brokers be aware of this legislation during the 2010 session. We will continue to monitor this and other potential bills that could affect ticket resale.
